STELLAR KEY REAL ESTATE LLC (Brokerage Services Edition)

These General Terms & Conditions (“Terms”) govern the use of brokerage services provided by Stellar Key Real Estate LLC (“Company”). By engaging our brokerage services, clients agree to the following Terms:

1. Scope of Brokerage Services

Stellar Key Real Estate LLC offers the following services:

• Facilitating the sale, purchase, or rental of residential and commercial properties.
• Assisting clients with off-plan property transactions.
• Providing market insights and advisory services tailored to clients’ real estate needs.

Our role is to act as an intermediary between buyers, sellers, landlords, and tenants, ensuring a seamless transaction process.

2. Client Obligations

a) Accuracy of Information: Clients must provide complete and accurate details about their requirements, property preferences, and financial capabilities. b) Documentation: Clients are required to submit all necessary legal and identification documents to comply with UAE regulations, including but not limited to:

• Emirates ID (for residents)
• Passport copy (for non-residents)
• Trade license (for corporate clients)
   c) Financial Readiness: Clients engaging in a property transaction must ensure sufficient funds or approved financing is available.

3. Brokerage Fees & Commissions

a) Sales Transactions: Stellar Key Real Estate LLC charges a standard commission of 2% of the sale price, unless otherwise agreed in writing. b) Rental Transactions: For rental properties, the brokerage fee is 5% of the annual rental value or as per market norms. c) Payment Terms: All fees and commissions are payable upon the successful completion of the transaction and are non-refundable.

4. Marketing and Advertising

a) Stellar Key Real Estate LLC may advertise or promote a client’s property on various platforms to attract potential buyers or tenants. b) Clients authorize the Company to use property details, including photographs, floor plans, and descriptions, for marketing purposes.

5. Confidentiality

We maintain strict confidentiality regarding all client information and transaction details. Information will only be disclosed as required by UAE law or regulatory authorities.

6. Property Listings

a) Stellar Key Real Estate LLC ensures that all property listings are accurate at the time of publication; however, availability and pricing are subject to change without prior notice. b) The Company is not liable for changes made by property owners or developers.

7. Liability

a) Stellar Key Real Estate LLC acts solely as a broker and is not responsible for any defects, issues, or disputes related to the property post-transaction. b) Clients are encouraged to conduct their own due diligence, including property inspections and legal checks, before completing a transaction. c) However, Stellar Key Real Estate LLC will provide reasonable assistance to the client in resolving any post-transaction concerns by offering guidance, recommendations, or support in liaising with the relevant parties (e.g., developers, property owners, or tenants).

8. Termination of Engagement

a) Either party may terminate the brokerage agreement with written notice. b) Any termination by the client after significant brokerage services have been rendered may be subject to applicable fees.

9. Dispute Resolution

a) Any disputes arising from these Terms or the brokerage services provided will be resolved amicably through negotiation. b) If unresolved, disputes may be referred to the Dubai Land Department (DLD) or other relevant authorities for arbitration or adjudication.

10. Governing Law

These Terms are governed by the laws of the United Arab Emirates and are subject to the exclusive jurisdiction of the courts in Dubai.

11. Force Majeure

Stellar Key Real Estate LLC shall not be held liable for delays or failures in providing services caused by events beyond its control, including natural disasters, government actions, or technical disruptions.

12. Client Acknowledgment

By engaging the brokerage services of Stellar Key Real Estate LLC, clients acknowledge and accept these Terms in full.
